These Terms govern your use of the Nafsy iOS app operated by NUNE LLC. Nafsy is a general wellness companion, not a medical device or therapy. Use good judgment with AI outputs. You can delete your account in-app at any time.
By accessing or using the Nafsy iOS app and related in-app services (the "Service"), you agree to these Terms of Use ("Terms") and our Privacy Policy, which is incorporated by reference.
If you obtained the app from Apple's App Store: Your use is governed by Apple's Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms provide additional governance for using the Service and supplement Apple's Standard EULA. Where Apple's Standard EULA and these Terms conflict regarding your relationship with Apple, Apple's Standard EULA governs.
These Terms constitute a binding agreement between you and NUNE LLC ("we," "us," "our," or "the Company"), a Wyoming limited liability company.
You must be at least 18 (or the age of digital consent in your jurisdiction, whichever is higher) and have legal capacity to enter into binding agreements. Provide accurate information, keep credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for all activity under your account.
Nafsy offers AI conversations (Coach, Companion, Vent), mood tracking and analytics with optional notes/tags, guided exercises (breathing, mindfulness, journaling, movement, relaxation) with audio guidance, optional real-time voice sessions, weekly AI summaries, offline-first use with secure sync, optional reminders, and multilingual support. Features may be added, modified, or discontinued; material changes will be communicated in-app.
Important: Nafsy provides general wellness support only. It is not a medical device, diagnosis/treatment service, therapist, or crisis line, and it is not monitored 24/7. Do not rely on the Service for medical decisions or emergencies.
In an emergency, call your local emergency number immediately.
To personalize your experience, Nafsy processes your wellness inputs (e.g., chats, mood logs, exercise activity, weekly summaries). By using the Service, you give explicit consent to this processing. You may withdraw consent by deleting your account; withdrawal ends your ability to use the Service and does not affect prior lawful processing.
You retain ownership of the content you submit. You grant NUNE LLC a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derivative works (e.g., summaries) solely to operate, secure, personalize, and improve the Service for you.
Text inputs may be processed by trusted AI providers to generate responses and perform safety checks. Voice sessions are ephemeral: we do not record audio, create transcripts, or retain voice content after the session ends; only minimal technical connection logs may exist briefly for security.
AI outputs may contain errors or biases; use your judgment. You may use outputs for any lawful purpose.
We rely on vendors for authentication, hosting, messaging, analytics/telemetry, AI processing, and content safety. Their terms and privacy notices may apply to those features. We contractually require appropriate safeguards and limited use of data to support the Service.
Some features may require a paid subscription or one-time purchase. If purchased through Apple, billing, renewal, cancellation, and refunds are managed by Apple via your Apple ID settings. Prices may change with required notice; taxes may apply. Unless required by law, fees are non-refundable.
Your use of the Service is governed by the Privacy Policy. We process sensitive wellness data with your explicit consent and honor access/portability by email request (no in-app export UI).
You may stop using the Service at any time and delete your account in-app. NUNE LLC may suspend or terminate access if we reasonably believe you violated these Terms, engaged in fraud/illegal conduct, or pose a risk to users or the Service. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive—including ownership/license, acceptable-use restrictions, disclaimers, limitations of liability, indemnity, and miscellaneous terms—survive termination.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We do not warrant uninterrupted or error-free operation or that outputs will be accurate or reliable.
To the maximum extent permitted by law, NUNE LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses. Our aggregate liability for all claims related to the Service will not exceed the greater of (A) amounts you paid in the six (6) months before the claim, or (B) USD $50. Some jurisdictions do not allow certain limitations; those parts may not apply.
You agree to indemnify and hold harmless NUNE LLC and its affiliates, officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use/misuse of the Service, or your violation of these Terms or applicable law.
We may modify these Terms. If changes are material, we will notify you in-app or by other reasonable means. Your continued use after the effective date constitutes acceptance.
Do not use the Service in violation of export control or sanctions laws.
You may not assign these Terms without our written consent; we may assign in connection with a merger, reorganization, or sale of assets.
If any provision is unenforceable, the remainder remains in effect; failure to enforce is not a waiver.
We are not liable for delays/failures due to events beyond our reasonable control.
These Terms and the Privacy Policy are the entire agreement between you and NUNE LLC for the Service.
Some features may be labeled beta/experimental and may change or be discontinued.
Do not use the app while driving or in situations requiring full attention.
We may send notices to your account email or within the app.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
